Factors In Child Custody Disputes

When parents engage in a bitter custody dispute it is the child who suffers the most. However, sometimes it is necessary for parents to go to court to resolve their disagreements over child custody. At Julaan Derrick, Attorney at Law, we will provide you the legal support necessary to preserve your parental rights and make sure your children's well-being is maintained. We are located in Conway, South Carolina, and serve clients throughout the community.

South Carolina family law states that your child's well-being is the most important consideration in any child custody matter. Most parents agree, but they often disagree what, exactly, is in their children's "best interests." Should the kids spend equal time with each parent, or live nearly all the time at one parent's house? Are both parents fit to take care of children?

Common Factors In Child Custody Disputes

Determining a child's best interests can be difficult. South Carolina Family Court judges consider many factors, including:

  • The preference of the child;
  • The ability of the parents to understand and meet the needs of the child;
  • The actions of each parent to encourage and foster a relationship between the child and the other parent;
  • The relocation of either parent;
  • The ability of the parent to be actively involved in the child's life;
  • Many other factors the Court considers necessary.

Be aware this is not a full list of child custody factors. The enumerated list of factors to be considered by the Court can be found in S.C. Code § 63-15-240(B). The court will weigh all relevant factors before issuing a ruling. Our job as your attorneys is to present a compelling case to convince the judge that yours is the preferred custody plan.
